And do not marry polytheistic women until they believe.[1] And a believing slave woman is better than a polytheist, even though she might please you. And do not marry polytheistic men [to your women] until they believe. And a believing slave is better than a polytheist, even though he might please you. Those invite [you] to the Fire, but AllŒh invites to Paradise and to forgiveness, by His permission. And He makes clear His verses [i.e., ordinances] to the people that perhaps they may remember.
1- i.e., worship and obey AllŒh alone.
And if he has divorced her [for the third time], then she is not lawful to him afterward until [after] she marries a husband other than him.[1] And if he [i.e., the latter husband] divorces her [or dies], there is no blame upon them [i.e., the woman and her former husband] for returning to each other if they think that they can keep [within] the limits of AllŒh. These are the limits of AllŒh, which He makes clear to a people who know [i.e.,understand].
1- With the intention of permanence, not merely in order to return to the previous husband.
And when you divorce women[1] and they have fulfilled their term, do not prevent them from remarrying their [former] husbands if they [i.e., all parties] agree among themselves on an acceptable basis. That is instructed to whoever of you believes in AllŒh and the Last Day. That is better for you and purer, and AllŒh knows and you know not.
1- For the first or second time.
There is no blame upon you for that to which you [indirectly] allude concerning a proposal to women or for what you conceal within yourselves. AllŒh knows that you will have them in mind. But do not promise them secretly except for saying a proper saying. And do not determine to undertake a marriage contract until the decreed period[1] reaches its end. And know that AllŒh knows what is within yourselves, so beware of Him. And know that AllŒh is Forgiving and Forbearing.
1- The Ôiddah (bereavement period) after the death of a husband.
And if you fear that you will not deal justly with the orphan girls, then marry those that please you of [other] women, two or three or four. But if you fear that you will not be just, then [marry only] one or those your right hands possess [i.e., slaves]. That is more suitable that you may not incline [to injustice].
And give the women [upon marriage] their [bridal] gifts[1] graciously. But if they give up willingly to you anything of it, then take it in satisfaction and ease.[2]
1- The obligatory bridal gift (mahr).
2- Knowing that it is lawful.
O you who have believed, it is not lawful for you to inherit women by compulsion.[1] And do not make difficulties for them in order to take [back] part of what you gave them[2] unless they commit a clear immorality [i.e., adultery]. And live with them in kindness. For if you dislike them – perhaps you dislike a thing and AllŒh makes therein much good.
1- The deceased man's heirs have no rights of marriage or otherwise over his widow.
2- At the time of marriage as mahr.
But if you want to replace one wife with another and you have given one of them a great amount [in gifts], do not take [back] from it anything. Would you take it in injustice and manifest sin?
And how could you take it while you have gone in unto each other and they have taken from you a solemn covenant?
And do not marry those [women] whom your fathers married, except what has already occurred.[1] Indeed, it was an immorality and hateful [to AllŒh] and was evil as a way.
1- Before IslŒm. After the ruling was revealed by AllŒh, men were required to release those women unlawful to them (e.g., a stepmother, one of two sisters, or any wives over the limit of four). The same obligation applies to one once he has accepted IslŒm.
Prohibited to you [for marriage] are your mothers, your daughters, your sisters, your father's sisters, your mother's sisters, your brother's daughters, your sister's daughters, your [milk] mothers who nursed you, your sisters through nursing, your wives' mothers, and your step-daughters under your guardianship [born] of your wives unto whom you have gone in. But if you have not gone in unto them, there is no sin upon you. And [also prohibited are] the wives of your sons who are from your [own] loins, and that you take [in marriage] two sisters simultaneously, except for what has already occurred.[1] Indeed, AllŒh is ever Forgiving and Merciful.
1- See previous footnote.
And [also prohibited to you are all] married women except those your right hands possess.[1] [This is] the decree of AllŒh upon you. And lawful to you are [all others] beyond these, [provided] that you seek them [in marriage] with [gifts from] your property, desiring chastity, not unlawful sexual intercourse. So for whatever you enjoy [of marriage] from them, give them their due compensation[2] as an obligation. And there is no blame upon you for what you mutually agree to beyond the obligation. Indeed, AllŒh is ever Knowing and Wise.
1- i.e., slaves or war captives who had polytheist husbands.
2- The mahr, a specified gift to the bride required of the man upon marriage.
And whoever among you cannot [find] the means to marry free, believing women, then [he may marry] from those whom your right hands possess of believing slave girls. And AllŒh is most knowing about your faith. You [believers] are of one another. So marry them with the permission of their people and give them their due compensation [i.e., mahr] according to what is acceptable. [They should be] chaste, neither [of] those who commit unlawful intercourse randomly nor those who take [secret] lovers. But once they are sheltered in marriage, if they should commit adultery, then for them is half the punishment for free [unmarried] women. This [allowance] is for him among you who fears affliction [i.e., sin], but to be patient is better for you. And AllŒh is Forgiving and Merciful.
Men are in charge of women[1] by [right of] what AllŒh has given one over the other and what they spend [for maintenance] from their wealth. So righteous women are devoutly obedient, guarding in [the husband's] absence what AllŒh would have them guard.[2] But those [wives] from whom you fear arrogance[3] – [first] advise them; [then if they persist], forsake them in bed; and [finally], strike them [lightly].[4] But if they obey you [once more], seek no means against them. Indeed, AllŒh is ever Exalted and Grand.
1- This applies primarily to the husband-wife relationship.
2- i.e., their husbands' property and their own chastity.
3- i.e., major rebellion or refusal of basic religious obligations.
4- This final disciplinary measure is more psychological than physical. It may be resorted to only after failure of the first two measures and when it is expected to amend the situation and prevent family breakup; otherwise, it is not acceptable. The Prophet ^ (who never struck a woman or a servant) additionally stipulated that it must not be severe or damaging and that the face be avoided.
And if you fear dissension between the two, send an arbitrator from his people and an arbitrator from her people. If they both desire reconciliation, AllŒh will cause it between them. Indeed, AllŒh is ever Knowing and Aware.
And they request from you, [O Muúammad], a [legal] ruling concerning women. Say, "AllŒh gives you a ruling about them and [about] what has been recited to you in the Book concerning the orphan girls to whom you do not give what is decreed for them[1] – and [yet] you desire to marry them – and concerning the oppressed among children and that you maintain for orphans [their rights] in justice." And whatever you do of good – indeed, AllŒh is ever Knowing of it.
1- i.e., their rights, in general, and their mahr, specifically.
And if a woman fears from her husband contempt or evasion, there is no sin upon them if they make terms of settlement between them – and settlement is best. And present in [human] souls is stinginess.[1] But if you do good and fear AllŒh – then indeed AllŒh is ever, of what you do, Aware.
1- i.e., holding on to self-interests.
And you will never be able to be equal [in feeling] between wives, even if you should strive [to do so]. So do not incline completely [toward one] and leave another hanging.[1] And if you amend [your affairs] and fear AllŒh – then indeed, AllŒh is ever Forgiving and Merciful.
1- Neither divorced nor enjoying the rights of marriage.
But if they separate [by divorce], AllŒh will enrich each [of them] from His abundance. And ever is AllŒh Encompassing and Wise.
And they who guard their private parts
Except from their wives or those their right hands possess,[1] for indeed, they will not be blamed –
1- Female slaves or captives under their ownership.
But whoever seeks beyond that, then those are the transgressors –
The fornicator does not marry except a [female] fornicator or polytheist, and none marries her except a fornicator[1] or a polytheist, and that [i.e., marriage to such persons] has been made unlawful to the believers.
1- Included in this ruling is the adulterer as well. Such persons cannot be married to believers unless they have repented and reformed.
And marry the unmarried among you and the righteous among your male slaves and female slaves. If they should be poor, AllŒh will enrich them from His bounty, and AllŒh is all-Encompassing and Knowing.
But let them who find not [the means for] marriage abstain [from sexual relations] until AllŒh enriches them from His bounty. And those who seek a contract [for eventual emancipation] from among whom your right hands possess[1] – then make a contract with them if you know there is within them goodness and give them from the wealth of AllŒh which He has given you. And do not compel your slave girls to prostitution, if they desire chastity, to seek [thereby] the temporary interests of worldly life. And if someone should compel them, then indeed, AllŒh is [to them], after their compulsion, Forgiving and Merciful.
1- i.e., those slaves who desire to purchase their freedom from their owners for a price agreed upon by both.
And of His signs is that He created for you from yourselves mates that you may find tranquility in them; and He placed between you affection and mercy. Indeed in that are signs for a people who give thought.
And [remember, O Muúammad], when you said to the one on whom AllŒh bestowed favor and you bestowed favor,[1] "Keep your wife and fear AllŒh," while you concealed within yourself that which AllŒh is to disclose.[2] And you feared the people,[3] while AllŒh has more right that you fear Him.[4] So when Zayd had no longer any need for her, We married her to you in order that there not be upon the believers any discomfort [i.e., guilt] concerning the wives of their claimed [i.e., adopted] sons when they no longer have need of them. And ever is the command [i.e., decree] of AllŒh accomplished.
1- Referring to the Prophet's freed slave, Zayd bin îŒrithah.
2- i.e., AllŒh's command to the Prophet () to marry Zaynab after Zayd divorced her. This was to demonstrate that a man may marry a woman formerly married to his adopted son.
3- i.e., feared their saying that the Prophet () had married the (former) wife of his son (which is prohibited by AllŒh in the case of a true, begotten son).
4- By making known His command.
O you who have believed, when you marry believing women and then divorce them before you have touched them [i.e., consummated the marriage], then there is not for you any waiting period to count concerning them. So provide for them and give them a gracious release.
Not lawful to you, [O Muúammad], are [any additional] women after [this], nor [is it] for you to exchange them for [other] wives, even if their beauty were to please you, except what your right hand possesses. And ever is AllŒh, over all things, an Observer.[1]
1- See footnote to verse 4:1.
O you who have believed, when the believing women come to you as emigrants, examine [i.e., test] them. AllŒh is most knowing as to their faith. And if you know them to be believers, then do not return them to the disbelievers; they are not lawful [wives] for them, nor are they lawful [husbands] for them. But give them [i.e., the disbelievers] what they have spent.[1] And there is no blame upon you if you marry them when you have given them their due compensation [i.e., mahr]. And hold not to marriage bonds with disbelieving women, but ask for what you have spent and let them [i.e., the disbelievers] ask for what they have spent.[2] That is the judgement of AllŒh; He judges between you. And AllŒh is Knowing and Wise.
1- For marriage, i.e., compensate their loss.
2- When a disbelieving wife chose to join the disbelievers, a Muslim husband could demand in return the equivalent of her mahr. Likewise, the disbelievers had a similar right when a believing woman joined the Muslims. This and the following verses were revealed subsequent to the Treaty of al-îudaybiyyah.
